Studio Within – Terms & Conditions

Face & Body Sculpting by Aimee – Bespoke Growth Package

1. Parties & Definitions

These Terms & Conditions (“Terms”) govern the agreement between:

• Studio Within (“we”, “us”, “our”)
  
• Face & Body Sculpting by Aimee (“the Client”, “you”)
  

in relation to the purchase and delivery of a bespoke digital growth package (“the Package”).

2. Scope of Work

The Package includes only the services expressly outlined in:

• The onboarding portal
  
  

Studio Within will deliver the agreed services with reasonable care and skill, in accordance with Section 49 of the Consumer Rights Act 2015 (where applicable).

Any work outside of the agreed scope, including additional features, revisions, or ongoing support, will be subject to additional fees.

3. Client Obligations

The Client agrees to:

• Provide all requested information, access, and assets promptly
  
• Ensure all business, treatment, pricing, and operational information is accurate and lawful
  
• Upload requested content within specified timeframes (including the 5-day image upload requirement)
  
• Review and approve deliverables within a reasonable timeframe
  

Studio Within shall not be liable for delays caused by the Client’s failure to meet the above obligations.

Project timelines may be extended or rescheduled accordingly.

4. Revisions & Post-Completion Work

• The Package includes delivery of the agreed scope only
  
• Minor revisions during the active build phase may be accommodated at our discretion
  

Following project completion and handover:

• All further edits, updates, or support are chargeable
  
• No ongoing services are implied unless separately agreed in writing
  

5. Payment Terms

• Full payment is required upfront prior to commencement
  
• No work will begin until payment is received in full
  

Where the Client elects to use third-party finance providers (including but not limited to Klarna or Shop Pay instalments):

• Studio Within is not a party to that agreement
  
• All obligations remain between the Client and the provider
  
• Studio Within bears no liability for payment disputes, defaults, or terms associated with such providers
  

6. Refunds

Refunds are not contingent on business performance or results.

A refund will only be considered where:

• Studio Within has failed to deliver the agreed scope of work
  
• And such failure is material and demonstrable
  

No refunds will be issued for:

• Change of mind
  
• Delays caused by the Client
  
• Dissatisfaction based on subjective preference where work meets the agreed brief
  

7. Results & Performance Disclaimer

The Client acknowledges that:

• The Package is designed to support business growth
  
• However, no guarantees are made in relation to:
  
  
  Revenue
  
  
  Bookings
  
  
  Leads
  
  
  Conversion rates
  
  
  Business performance
  
  
  

Outcomes depend on factors outside Studio Within’s control, including:

• Market conditions
  
• Pricing strategy
  
• Client operations
  
• Ongoing marketing activity
  

8. Third-Party Platforms

The Package may involve integration with third-party platforms including (but not limited to):

• Shopify
  
• Fresha
  
• Google
  
• Social media platforms
  

The Client agrees that:

• All platform fees, commissions, and subscriptions are their responsibility
  
• Studio Within is not liable for:
  
  
  Platform outages
  
  
  Policy changes
  
  
  Pricing changes
  
  
  Performance or functionality of third-party systems
  
  
  

9. Data Protection & Regulatory Compliance

The Client is the data controller for all personal data processed in connection with their business.

The Client is solely responsible for:

• Compliance with the UK GDPR and Data Protection Act 2018
  
• Storage, handling, and lawful processing of client data
  
• Medical, aesthetic, and treatment compliance
  
• Consent forms, consultation forms, disclaimers, and policies
  

Where Studio Within provides templates or creates materials (including forms, FAQs, pricing strategies or treatment information):

• These are provided for guidance only
  
• They do not constitute legal or regulatory advice
  
• The Client must independently review and approve all materials
  

Studio Within accepts no liability for:

• Legal compliance
  
• Regulatory breaches
  
• Data protection failures

• Margins or pricing strategy
  

10. Intellectual Property

Upon full payment:

• The Client is granted a non-exclusive, perpetual licence to use the final deliverables for their business
  

Studio Within retains:

• Ownership of underlying concepts, processes, and frameworks
  
• The right to showcase the work for portfolio and marketing purposes
  

11. Project Completion & Handover

The project is deemed complete upon:

• Delivery of all agreed scope of works
  
• Handover of access and/or assets
  

From this point:

• Responsibility for use, performance, and maintenance transfers to the Client
  
• Studio Within’s obligations under this agreement are fulfilled (subject to Clause 12)
  

12. 12-Month Fixes Warranty

Studio Within provides a 12-month warranty from the date of project completion covering:

• Technical defects
  
• Bugs directly attributable to the original build
  

This warranty does not cover:

• Content changes or updates
  
• New features or enhancements beyond the initial scope of work
  
• Third-party platform issues
  
• Issues caused by Client edits or external developers
  

All non-warranty work will be chargeable.

13. Limitation of Liability

To the fullest extent permitted by UK law:

• Studio Within’s total liability shall not exceed the total amount paid by the Client for the Package
  

Studio Within shall not be liable for:

• Loss of profit
  
• Loss of revenue
  
• Loss of business opportunity
  
• Indirect or consequential loss
  

Nothing in these Terms excludes liability for:

• Death or personal injury caused by negligence
  
• Fraud or fraudulent misrepresentation
  
• Any liability which cannot be excluded under UK law
  

14. Force Majeure

Studio Within shall not be liable for failure or delay in performance due to events beyond reasonable control, including but not limited to:

• Acts of God
  
• Internet or platform outages
  
• Government restrictions
  
• Illness or incapacity
  

15. Timeline & Delays

Project timelines are dependent on timely Client input.

Where Client delays exceed 7 working days:

• Studio Within reserves the right to:
  
  
  Reschedule delivery timelines
  
  
  Reallocate project resources
  
  
  Place the project on hold
  
  
  

Recommencement may be subject to availability.

16. Termination

Studio Within reserves the right to terminate the agreement where:

• The Client breaches these Terms
  
• Required cooperation is not provided
  
• Communication ceases for an extended period
  

In such cases:

• No refund will be issued
  
• Work completed up to that point remains payable
  

17. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

18. Acceptance

By purchasing this Package, the Client confirms they:

• Have read and understood these Terms
  
• Agree to be legally bound by them
